Explains Policy

Sir: Permit me to express a
slight demurrer to your article
about the Department of High
ways and the Edenwald Con
tracting Company which is filling
potholes for us in Harlem under
a maintenance contract.
The story, the headline and es
pecially the "peewee” above the
headline left the impression that
it was illegal for the Department
not to know whether the contrac
tor discriminated against minori
ties in his hiring practices.
As it turned out, nine of Eden-
wald's 25 men on this contract
were Negroes. But the point is
this:
The Department is not equip
ped to investigate or police the
hiring practices of all its con
tractors. In many cases, the con
tractor hires his workers only
after he is awarded a contract
us the successful low bidder.
We insist that he sign a state
ment, which is a part of the
contract, that certifies he does
not discriminate. In addition, the
City Commission on Human
Hights is notified of each con
tract we let.
Let me stress that when a con
tractor is proved to be discri
minating against minorities,

cel the contract' in accordance
with the law and Mayor Wag
ner’s directive.
But proving that a contractor _
lied in his contract statement
goes beyond the practical func
tion and legal authority of this
Department or any other city
agency which awards construc
tion contracts.
These agencies, as a practical
matter, have to rely on their
contractors' signed statements
that they are not biased when
they hire workers, pre-check
ing the hiring practices of thous
ands of contractors would re
quire a good part of the man
power of these agencies and con
struction would come to a halt.
Specific charges of discrimina
tion should be lodged with the
City or State Commissions on
Human Rights, which will investi
gate the charges and make rec
ommendations.

Sir: In 1920, Dr. William Ed
ward Burghardt DuBois publish
ed his "Darkwater.” The chap
ter of “The Damnation of Wo
men” as a blistering indictment
of the white south for the degra
dation of Negro womanhood. I
doubt that Charlayne has read
this or that she knows much about
DuBois.
When he was on boat journey
ing to Germany to complete his
education, a young white woman
asked him to marry her. DuBois
frankly told her that he had some
work to finish, and that he had
not planned to marry any woman
who was not of African descent.
Now the question is: DuBois or
Charlayne?
If DuBois had elected to marry
this white woman, she was Euro
pean and perhaps she and her
family had no misgivings about
race and color. But Charlayne
elected to marry into a southern
white family, who no doubt had
been responsible for lynching and
raping of the manhood and wo
manhood of her race. Now, she
states that she is happy over
what she has done, but her hap
piness may have come all too
soon. Suppose her baby should
take the worse characteristic of
the white grandfather. Then the
grown-up baby may one day
lynch or rape the mother !
When the several states have
discovered that their state Con
stitutions were not modern, up-
to-date mandates for contempor
ary society, they held Constitut
ional Conventions to adopt new
Constitutions. We had one in New
York in 1938 and New Jersey had
one In 1948, which has given that
state one of the truly democratic
charters in our country. Why
then should the United States
Constitution be so sacred that it
cannot be hung in honor in the
Smithsonian Museum, while rep
resentatives of black and white
citizens sit down at a new Con
stitutional Convention and ham
mer out a Great New Charter for
our times?
The very amendments which
are supposed to give the Negro
citizenship the right to vote and
equal justice under the law, are
slandered and traduced by south
ern politicians. They claim that
the Fourteenth and Fifteenth
Amendments were rammed down
the throat of the south, while vic
torious Union armies were still
occupying the rebellious States
